This is the official offer of Kravets Serhii Petrovych, private entrepreneur, to conclude a contract for services in issuing electronic travel documents on the terms set out below. The contract is a contract of adhesion within the meaning of articles 633, 634, 641 and 642 of the Civil Code of Ukraine: its terms are the same for everybody and are accepted in full, without amendment.
Please read it before placing your first order.
1. Who is who
The Provider - Kravets Serhii Petrovych, private entrepreneur. The registration details are at the end of this document.
The Customer - a natural person with legal capacity, or a business entity, who has accepted this offer.
The Site - railukraine.com and the agency workspace agent.railukraine.com, together with all their pages and services.
The Carrier - JSC Ukrainian Railways and other carriers whose seats are available for booking through the Site.
The electronic travel document (ETD) - a ticket in electronic form. It is created and accounted for by the Carrier, who also performs the carriage.
The service fee - the Provider's remuneration for booking, separate from the Carrier's fare.
2. Subject of the contract
The Provider supplies the Customer with services in searching for, reserving, issuing, exchanging and refunding electronic travel documents, that is, acts as an intermediary between the Customer and the Carrier.
The Provider is not a carrier. It does not sell carriage in its own name, does not set fares and does not run trains. The timetable, boarding, luggage, concessions, delays and cancellations are governed by the law of Ukraine and by the Carrier's rules.
3. How the contract is concluded
The contract is concluded at the moment the offer is accepted. Acceptance is any of the following acts by the Customer: registering on the Site, placing an order, or paying for it.
The Provider has the right to change the terms of the contract. A new revision takes effect on the day it is published on this page and does not extend to orders placed earlier. The date of the last update is shown at the top of the page.
4. Who may use the Site
- A person who has reached the age of 18 and has full civil capacity. For anybody else, the order is placed by their legal representative.
- The Customer enters other passengers' details only with their consent, and in the case of children as their father, mother or guardian.
- The accuracy of passenger data (surname, first name, document type and number, date of birth) is the Customer's responsibility. If the data does not match the document, the Carrier has the right to refuse boarding, and that is not grounds for a refund by the Provider.
- The Customer keeps access to their own account and their password themselves. Acts done under their login are taken to be their acts.
5. How a ticket is issued
- The Customer chooses the train, carriage and seat, and enters passenger details and a contact address.
- The seat is held for the limited time needed to pay. If no payment arrives, the reservation is cancelled automatically.
- Once payment succeeds, the ETD is sent to the email address given and is kept in the account under "My tickets".
- The order counts as performed at the moment the Carrier has issued the ETD.
- Booking is possible only within the sales period set by the Carrier. Seat availability and price are confirmed at the moment of booking: before payment they may change on the Carrier's side.
- To board you need the ETD and an identity document whose details match the ticket. The form in which the ticket must be presented is set by the Carrier.
6. Price and payment
- The price of an order consists of the Carrier's fare and the Provider's service fee where one applies. Both parts are shown separately before payment. Where no fee is charged, the Customer pays exactly the Carrier's fare.
- Settlement is in hryvnia.
- Card payments go through the LiqPay payment service. The Customer enters the card details on the payment service's side: the Provider does not receive, see or store them.
- Partner agencies pay for orders from a balance or against an invoice on the terms of a separate contract.
- An order counts as paid once the payment service confirms it.
- If money has been taken and no ETD has been issued, the Provider returns the whole sum paid, the service fee included.
7. Refunds and changes to tickets
- The grounds for a refund and the amount withheld are set by the Carrier. The Provider has no right either to increase or to reduce them.
- The Customer files a refund request through the contact form on the Site, giving the order number. If the ETD has already been exchanged for a paper form, it can only be refunded at a Carrier's ticket office.
- Money is returned by the same means it was paid, to the same card or account. The time it takes to arrive depends on the bank and usually does not exceed ten banking days.
- The service fee for booking is not returned: the Provider's service has already been performed by the time of the refund. The exception is where the refund happened through the Provider's fault.
- The right to withdraw from a contract concluded at a distance does not extend to passenger carriage services or to reservations for a fixed date, so refunds follow the Carrier's rules.
8. What may not be done
- Harvesting the Site's data automatically, scraping the timetable or prices, or creating a load beyond ordinary use.
- Making reservations without the intention of paying for them.
- Using payment cards without the holder's permission.
- Creating several accounts in order to get round a restriction or to pose as somebody else.
- Copying the Site's content for commercial use, interfering with its operation, or circumventing technical restrictions.
The Provider has the right to restrict access to the Site and to cancel the unpaid reservations of a Customer who breaks these rules. Tickets already issued and paid for remain valid.
9. Liability
The Site is provided "as is". The Provider maintains it in good faith but does not guarantee uninterrupted operation: some of the data comes from the Carrier's systems and depends on them.
The Provider is not answerable for:
- the delay, cancellation or rerouting of a train, the acts of the Carrier's staff, or a refusal to allow boarding;
- a passenger being late, or the consequences of errors in the data the Customer entered;
- a message not arriving because of a wrong address or the mail provider's filters;
- failures on the side of the Carrier, the payment service, a bank or a telecommunications operator.
The Provider is answerable for its own acts: if an ETD was not issued, or was issued wrongly through its fault, it corrects the mistake or returns the money. The Provider's aggregate liability on one order is limited to the sum paid for that order. The limitation does not apply where the law of Ukraine does not allow it.
10. Personal data
The Provider processes personal data in accordance with the Law of Ukraine "On the Protection of Personal Data" and the Privacy policy, which is an integral part of this contract.
The amount of data is the minimum needed to issue a ticket. Part of it the Provider is obliged to pass to the Carrier: without that there is no ETD. In placing an order the Customer confirms that they have read the Privacy policy and that other passengers' details were entered with their consent.
11. Intellectual property
The Site, its program code, design, texts and databases belong to the Provider or are used by it on lawful grounds. The Customer has the right to use the Site for its purpose. Any reproduction of the Site's materials for commercial purposes, in particular the automated extraction of the timetable or prices, requires the Provider's written consent.
12. Force majeure
The parties are released from liability for non-performance caused by circumstances of insuperable force: military action, shelling, mobilisation, natural disaster, emergency power cuts, large-scale failures of communications and the internet, decisions of the authorities, or epidemics.
The party affected by such circumstances notifies the other within seven calendar days. For as long as they last, the time for performance is extended. If they last more than thirty days, either party may terminate the contract without penalty; money paid and not used is returned.
13. Claims and disputes
Disputes are settled by negotiation. Send a claim to [email protected] or through the contact form, giving the order number and the substance of the demand. The Provider considers it and gives a written answer within thirty calendar days.
If no agreement is reached, the dispute is settled by a court under the law of Ukraine. A Customer who is a consumer has the right to apply to a court at their place of residence.
14. Other terms
- The contract is in force from acceptance until the parties have performed their obligations in full.
- Holding a particular clause invalid does not make the contract as a whole invalid.
- The contract is drawn up in Ukrainian. Translations into other languages are for reference; in the event of a discrepancy the Ukrainian version applies.
